Volunteer Waiver, Release of Liability, Assumption of Risk & Media Release
By registering for and participating in the World's Largest Beach Cleanup ("Event"), I acknowledge and agree to the following:
1. Voluntary Participation
I understand that my participation in this Event is entirely voluntary. I choose to participate of my own free will and understand that I may discontinue my participation at any time.
2. Assumption of Risk
I understand that participation in a beach cleanup and related activities involves inherent risks, including but not limited to:
Slips, trips, and falls
Exposure to sun, heat, wind, ocean conditions, and weather
Contact with sand, water, rocks, marine life, debris, or hazardous materials
Cuts, scrapes, punctures, insect bites, or other injuries
Physical exertion and fatigue
Risks associated with traveling to and from the Event
I voluntarily assume all known and unknown risks associated with my participation.
3. Release of Liability
To the fullest extent permitted by law, I release and discharge the Event organizers, Planet Deep Blue, KOOK, Sea K Organics, LLC, all sponsors, volunteers, officers, directors, employees, contractors, partners, venue providers, governmental agencies, and affiliated organizations from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising from or related to my participation in the Event, including claims arising from ordinary negligence.
This release does not apply to gross negligence or willful misconduct where prohibited by law.
4. Medical Treatment
I authorize emergency medical treatment if deemed necessary while I am participating in the Event. I understand that I am solely responsible for any medical expenses incurred.
5. Health Representation
I certify that I am physically able to participate in the Event and have no medical condition that would make participation unsafe. If I have concerns regarding my health, I have consulted an appropriate medical professional before participating.
6. Personal Responsibility
I agree to follow all instructions provided by Event staff and volunteers, obey applicable laws, use reasonable care, and help maintain a safe environment for all participants.
I understand that I may be asked to leave the Event if I engage in unsafe, illegal, disruptive, or inappropriate conduct.
7. Media Release
I understand that photographs, videos, livestreams, audio recordings, and other media may be captured during the Event.
I grant the Event organizers, Planet Deep Blue, KOOK, Sea K Organics, LLC, sponsors, media partners, and their respective licensees the irrevocable, worldwide, royalty-free right to photograph, record, reproduce, edit, publish, distribute, display, and otherwise use my name, image, likeness, voice, and statements captured during the Event for promotional, educational, documentary, editorial, fundraising, marketing, social media, advertising, and other lawful purposes, in any media now known or later developed, without compensation or additional approval.
8. Children
Participants under the age of 18 must have a parent or legal guardian complete the registration and accept this waiver on their behalf. The parent or legal guardian represents that they have the authority to enter into this agreement for the minor participant.
9. Personal Property
I understand that I am responsible for my own belongings. The Event organizers are not responsible for any lost, stolen, or damaged personal property.
10. Event Changes
I understand that the Event schedule, activities, speakers, entertainment, location details, or other aspects of the Event may change without prior notice due to weather, safety concerns, governmental requirements, or other circumstances.
11. Cleanup Equipment
I understand that gloves, grabbers, buckets, and other cleanup equipment may be provided. I agree to use all equipment responsibly and return any borrowed equipment unless otherwise instructed.
12. Privacy
I understand that the information I provide during registration may be used to administer the Event, communicate important updates, and provide future information about cleanup initiatives, in accordance with the organizers' applicable privacy practices.
13. Governing Law
This agreement shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.
14. Severability
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
15. Electronic Acceptance
By checking the acceptance box during registration, I acknowledge that I have carefully read this Waiver, Release of Liability, Assumption of Risk, and Media Release, fully understand its contents, and agree to be legally bound by its terms. I understand that I am giving up certain legal rights by accepting this agreement.
